The reason you can claim back all of your bank charges is really easy. It is because bank charges are totally illegal. Naturally, the banks don’t agree with this, hence there is currently the High Court deciding the situation once and for all. The legislation
The main debate is that banks should only incur charges in proportion to their costs. This is because under present ‘breach of contract’ laws, the charge should never exceed the cost of the breach.
And as we all know they always do, and sting us with a £40 letter.
Yet go beyond your arranged overdraft limit or have a cheque or direct debit payment bounce and the banks will readily charge a whacking penalty of up to £40 a letter, just to inform you – even if you’re only £2 over your arranged limit. Yet all the bank has to do is send an automatically computer generated letter and afix a stamp to it, and take it to the postman. A recent study and report by a Professor of Banking estimated this costed only between £2.50 and £4.50. And this was being extremely generous too.
Of course, if you had bothered to read the terms & conditions when you got your back account, this was in there; or thats what the bank will tell you. Yet that’s completely irrelevant: the contract must be written within the UK law, and they certainly can’t enforce a contract with legally unlawful terms. Ultimately, if it isn't proportionate then it's unlawful, and hence you have every right to claim all of your money back.
